A Daubert hearing, derived from Daubert v. Merrell Dow Pharmaceuticals, 509 U.S. 579 (1993) and codified in amendments to Federal Rule of Evidence 702, is a pretrial gatekeeping proceeding in which the court assesses whether proposed expert testimony rests on a reliable methodology and will assist the trier of fact. Mass tort outcomes frequently turn on Daubert rulings concerning general causation, specific causation, epidemiology, and toxicology experts.
